Tribunal Fees

Following the decision by the Supreme Court that the tribunal fees regime is unlawful, cases no longer require fees to be paid and steps are being to address repayment where fees have been paid. Initially these cases were stayed but that stay has now been lifted.


There has been at least one case brought by a claimant alleging that when her claim was previously struck out for non payment of a fee, she should now be allowed to proceed with it. The Tribunal in Southampton agreed on the basis that this was a claim for discrimination and it would be just and equitable to do so.
